CAN-SPAM
For commercial email to recipients in the US you must: not use false or misleading headers or subject lines; identify the message as an advertisement where required; include a valid physical postal address; include a clear and conspicuous way to opt out that works for at least 30 days after sending; honour opt-outs within 10 business days; and not sell or transfer the addresses of people who opted out. Each separate email in breach can attract a very large civil penalty (over US$50,000 per email under current inflation adjustments). The law also applies to emails you send for your business through a service like PostaraMail.
PostaraMail adds your address and a one-click unsubscribe link, and honours unsubscribes immediately. Even though US law does not require prior opt-in, PostaraMail does not allow purchased or scraped lists.
State privacy and email laws
Many US states have comprehensive privacy laws (for example California, Colorado, Connecticut, Virginia, Texas and others) and some have their own commercial email rules. PostaraAI acts as your service provider or processor; the CCPA terms in the Data Processing Addendum apply. You are responsible for your own privacy notices, honouring opt-out and deletion requests from your contacts, and for state-law consent rules if you market to residents of those states.
Children and minors
Do not collect or email personal information from children under 13 (COPPA) or knowingly market to minors under state laws that restrict it.
Subscriptions, tax and other
Paid plans renew automatically as described in the Terms; you can cancel online at any time. We charge sales or use tax where required. The Service is not designed for text messages or phone marketing, which have separate US rules (such as the TCPA).
General information
This addendum is general information about the main rules for sending email and handling personal data. It is not legal advice and may not be complete. You remain responsible for complying with the law that applies to you and your recipients.
