Canada's Anti-Spam Legislation applies to commercial electronic messages sent to people in Canada, wherever you are. You generally need express consent, which must be an active opt-in (no pre-ticked boxes) and which you may not ask for by email. Implied consent applies only in narrow cases, such as an existing business relationship in the last two years or an enquiry in the last six months. You must keep records of consent: you have the burden of proving it.
Every message must identify you, give your contact information and a working unsubscribe mechanism that works for at least 60 days after sending, free of charge, and you must act on unsubscribe requests within 10 business days. Penalties can reach C$10 million per violation for organisations, and directors and officers can be personally liable.
Do not email purchased lists: you have no consent from those recipients.
What PostaraMail does for you
How PostaraMail helps: when you send a campaign you choose the regions to include; strict regions only include contacts with a clear opt-in; every contact stores the consent wording, time, source and country; double opt-in is available; unsubscribes take effect immediately; and you can export a consent record for any contact.
Privacy law and Québec
PIPEDA and provincial privacy laws (including Québec's Law 25) apply to personal information. You are responsible for your privacy notices and for handling requests from your contacts. If you are in Québec and need a French version of our agreement, contact us at support@postaramail.com.
