Australia: Spam Act 2003
The Spam Act applies to commercial electronic messages with an Australian link. You need the recipient's consent, which can be express or, in limited cases, inferred from an existing relationship or a conspicuously published business address related to your offer. You must be able to show evidence of consent. Every message must clearly identify the sender with contact details that are valid for at least 30 days, and contain a functional unsubscribe facility that works for at least 30 days, is free, and is actioned within 5 working days. Penalties are civil and can be very large, per day of contravening conduct.
You may not use an email to ask for consent: that email would itself be a commercial message.
Australia: privacy and consumer law
The Privacy Act 1988 and the Australian Privacy Principles apply to many businesses; you are responsible for notices, cross-border disclosure and handling requests. The Australian Consumer Law gives consumers guarantees that cannot be excluded; the Service is for business use.
New Zealand
The Unsolicited Electronic Messages Act 2007 requires consent, clear identification of the sender, and a functional unsubscribe in every commercial message. The Privacy Act 2020 and its information privacy principles apply to personal information, including limits on sending it overseas.
What PostaraMail does for you
How PostaraMail helps: when you send a campaign you choose the regions to include; strict regions only include contacts with a clear opt-in; every contact stores the consent wording, time, source and country; double opt-in is available; unsubscribes take effect immediately; and you can export a consent record for any contact.
General information
This addendum is general information about the main rules for sending email and handling personal data. It is not legal advice and may not be complete. You remain responsible for complying with the law that applies to you and your recipients.
